# Intellectual property

> How ourdream handles named characters, real people, deepfakes, and copyrighted worlds.

ourdream prohibits content that infringes intellectual property or depicts
real individuals without consent. This page describes the line, the
process for flagging infringements, and the takedown workflow.

## What's prohibited

### Named characters from existing IP

Characters drawn from copyrighted works by name, design, or recognisable
identity:

* ❌ "Naruto" as a public character
* ❌ "You are Sung Jin-woo"
* ❌ Characters whose appearance closely matches a specific copyrighted
  character

### Named worlds and storylines

Settings, locations, factions, and storylines from copyrighted works:

* ❌ A scenario set "in the world of \[named franchise]"
* ❌ A character described as a member of "the \[copyrighted faction]"

### Real people

Characters depicting real individuals. See
[Prohibited content → Real people](/policies/prohibited-content#real-people).
This applies to alive individuals and to those deceased less than 100
years.

### Recognisable likeness

Original characters whose faces or features closely resemble a specific
real person, even if not named. The threshold is whether a reasonable
viewer would identify the original.

## What's allowed

* ✅ Original characters in a *style* or *genre* (cyberpunk noir,
  magical academy, isekai-adjacent)
* ✅ Generic archetypes that evoke a vibe without using protected names
  or storylines
* ✅ Public-domain works (older than \~95 years in most jurisdictions)
* ✅ Parody, satire, and clearly transformative work (see below)

### Parody and transformative use

We apply a posture similar to how YouTube treats fair use: parody,
satire, commentary, and clearly transformative work that references a
copyrighted property without reproducing its specific characters or
storylines is allowed. The judgement is made case-by-case, and the
burden sits with the creator to make the transformation obvious.

For parody of public figures specifically, all of the following must
be true:

* The work is recognisably parodic (humorous, satirical, or
  transformative).
* The figure is a public figure (politician, executive, public-facing
  celebrity), not a private person.
* The work doesn't make false statements of fact about the individual.

The parody allowance is narrow on purpose. When in doubt, we default
to removal. The creator can always appeal and make the case.

## Reporting an infringement

Rights-holders and their authorised representatives can submit takedown
notices.

### DMCA notices (United States)

Send to **[trust@ourdream.ai](mailto:trust@ourdream.ai)**. The notice must include:

1. Identification of the copyrighted work claimed to be infringed.
2. Identification of the allegedly infringing material on ourdream
   (URL, character name, or username).
3. Contact information.
4. A statement of good-faith belief that the use is unauthorised.
5. A statement, under penalty of perjury, that the information is
   accurate and that you are authorised to act for the rights-holder.
6. A physical or electronic signature.

We act expeditiously on complete DMCA notices, as required by the
statute.

### EU and UK requests

Rights-holders in the EU and UK can use the same email channel.
Notices will be processed under the **EU Digital Services Act
notice-and-action mechanism** (Regulation 2022/2065, Article 16) and,
for UK users, under the equivalent illegal-content reporting duties
in the **UK Online Safety Act 2023**. Notices that include the same
identifying information required for a DMCA notice (work, infringing
URL, contact info, good-faith statement) will be actioned
expeditiously.

### Real-person likeness reports

Individuals depicted without consent (or their authorised
representatives) can request removal through the same channel. We do
not require a legal
filing for clear-likeness cases.

## Counter-notices and republication

If your content was removed and you believe the takedown was incorrect,
you can submit a counter-notice. The DMCA counter-notice process —
including the required statements and the restoration timeline — is set
out in the
[Terms of Service](https://ourdream.ai/terms/terms-of-service). For

## Repeat-infringer policy

Accounts that repeatedly post infringing material are subject to
suspension and, on further violation, permanent termination. The
threshold is documented in our
[Terms of Service](https://ourdream.ai/terms).
